PechaKucha, Inc. (“Company”, “we” or “us”) respect your privacy and are committed to protecting it through our compliance with this privacy policy (this “Privacy Policy”).
This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit any PechaKucha website (the “PK Site”) including, but not limited to, https://www.pechakucha.com, https://pechakucha.shop, or https://create.pechakucha.com, and, if available, our mobile application (the “PK App,” and together with the PK Site, the “PK Platform”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.
We recognize that the privacy of your information is important to you, and it is of paramount importance to us. The purpose of this policy is to let you know how we handle the information you voluntarily provide to us or that we collect through your voluntary use of the PK Platform. It is our policy to notify users (and obtain their acceptance) of our Privacy Policy and our Terms of Use (found at https://www.pechakucha.com/termsofuse) with a notice on the PK Platform home page during the user’s first visit to the PK Platform and whenever there is a material change to our Privacy Policy or our Terms of Use.

We are a young company and are continuously working to better support and serve the security needs of our growing userbase and business partners.

Please understand that your use of the PK Platform is strictly voluntary. If you believe your use of the PK Platform is not voluntary, at any time, for any reason, please contact us immediately.
This Privacy Policy applies to information we collect:
- On the PK Platform.
- In email, text, and other electronic messages between you and this PK Platform.
It does not apply to information collected by:
- us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
- any third party, including through any application or content (including advertising) that may link to or be accessible from or on the PK Platform.

If we learn we have collected or received personal information from a person under 18 without verification of parental consent, we will delete that information. Information We Collect Through Automatic Data Collection Technologies As you navigate through and interact with our PK Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
- Details of your visits to our PK Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the PK Platform.
- Information about your computer and internet connection, including your IP address, operating system, and browser type.
We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

We may collect personal information about you from other users, our affiliates, and third parties, as permitted by law. For example, we may collect information from social media platforms, mailing list providers, and publicly available sources.
How We Use Your Information
Personal Information
To provide the PK Platform and our services: Company may use your personal information to fulfill requests for products, services, or information, including information about potential or future services, including to:
- Manage individual information and accounts;
- Respond to questions, comments, and other requests;
- Process payment for products or services purchased;
- Create online accounts to utilize the PK Platform;
- Provide access to certain areas, functionalities, and features of the PK Platform; and

- Measure interest in the PK Platform and events;
- Develop new products and services or improve existing products and services, including the PK Platform;
- Ensure internal quality control;

- Business partners. We may share personal information with our business partners, affiliates, and for our affiliates’ internal business purposes or to provide you with a product or service that you have requested. We may also share personal information with business partners with whom we may jointly offer products or services, or whose products or services we believe may be of interest to you, or who are putting on events for which you have registered through the PK Platform.
- With third parties for legal reasons. We may share information about you if we reasonably believe that disclosing the information is needed to:
- comply with any valid legal process, governmental request, or applicable law, rule, or regulation;
- investigate, remedy, or enforce potential Terms of Use violations;
- protect the rights, property, and safety of us, our users, or others; or

- With third parties as part of a merger or acquisition. In the event of a transaction or proposed transaction involving the transfer of substantially all of the assets of the Company or one or more of its businesses to another entity, whether an affiliate or a third party, or in connection with a bankruptcy, we may share your personal information in the diligence process or to otherwise facilitate the transaction, and with individuals assisting in the transaction or in connection with a bankruptcy. Your personal information may also be one of the transferred assets as part of the transaction or bankruptcy.
Cookies & Analytics Technologies
In operating the PK Platform, we may use a technology called "cookies." A cookie is a piece of information that the computer that hosts the PK Platform gives to your browser when you access the PK Platform. Our cookies help provide additional functionality to the PK Platform, including helping us analyze usage more accurately. For instance, the PK Platform may set a cookie on your browser that allows you to access the PK Platform without needing to remember and then enter a password more than once during a visit to the PK Platform. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off. We recommend that you leave cookies turned on because they allow you to take advantage of some of the PK Platform features.

We may also use analytics tools such as Google Analytics to collect information regarding visitor behavior and visitor demographics on the PK Platform, and to develop website content. Web Beacons
We may employ a software technology called clear gifs (a.k.a. Web Beacons) that help us better manage content on the PK Platform by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We may tie the information gathered by clear gifs to our customers’ personal information. We may use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.
External Sites
The PK Platform may contain links to other websites and other websites may reference or link to the PK Platform. These websites are operated by third parties not controlled by us, and by linking to them or being linked from them Company does not endorse, approve or make any representations about third-party websites or domains. We encourage you to read the privacy policies of each and every website and domain that you interact with. We are not responsible for the privacy practices or content of such other websites or domains and you visit them at your own risk.
Social Media
The PK Platform may contain links and interactive features with various social media platforms. If you already use these platforms, their cookies may be set on your device when using the PK Platform. You should be aware that personal information which you voluntarily include and transmit online in a publicly accessible social media platform, blog, or chat room, or otherwise online, or that you share in an open forum, may be viewed and used by others without any restrictions. We have no control over such uses of your information when interacting with a social media platform, forums or otherwise online and by using such services you assume the risk that the personal information provided by you may be viewed and used by third parties.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the PK Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the PK Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the PK Platform.

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Accessing and Correcting Your Information
You can review and change your personal information by logging into the PK Platform and visiting your account profile page.
You may also send us an email at support@pechakucha.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We will respond to your request in accordance with the applicable law that governs the collection, use and deletion of your data and information. The requested deletion will be as comprehensive as possible but is always subject to issues outside of our control, including applicable regulations and laws, your actions and the actions of third parties. It is important to note that we may retain a copy of the information for archival purposes and to avoid identity theft or fraud.
You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your personal data infringes applicable law.
Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the PK Platform home page. If we make material changes to how we treat our users' personal information, we will notify you by email to the email address specified in your account and/or through a notice on the PK Platform home page. The date the privacy policy was last revised is identified at the top of the page.
